PLANITROI recommends backing up all files before releasing equipment. Once you have sent your equipment to PLANITROI, you have released all rights to your equipment. PLANITROI cannot, and does not guarantee that it will be able to honor any request for return of the equipment and/or data contained in that equipment. You must own the right, title, and interest in any and all items you seek to sell through these services. Such items or the sale and shipment of such items must not violate any applicable laws, statutes, ordinances, or regulations, including export laws. Any items you seek to sell to PLANITROI shall not infringe on any third-party intellectual property rights (including copyright, trademarks, patent, trade secrets, or other proprietary rights); and shall not be counterfeit, stolen, or fraudulent.

To receive full value for your equipment, you must accurately state your current product's grade according to the grading system on this site. PLANITROI will perform an audit upon receipt of your product. If the product's condition differs materially from that which you described, PLANITROI reserves the right to resell your equipment and return 50% of the proceeds less any services required. Once you ship your equipment, PLANITROI will be solely responsible for ensuring that it is re-distributed and/or recycled in accordance with applicable Environmental Protection Agency regulations. Units with no value will be recycled at a cost of $0.50 per lbs including shipping.

You agree to state your product's grade accurately and to the best of your ability based on the guidelines posted on this site. Packing and shipping recommendations should be followed to avoid possible damage or loss. If the product is damaged during shipping and there is visible damage to the packing materials (box is dented, ripped, smashed, etc.), you will take responsibility for resolving any claims with the carrier.

THESE TERMS AND CONDITIONS ARE GOVERNED BY NEW JERSEY LAW, AND NO LAWS OR PROVISIONS OF ANY OTHER JURISDICTION WILL APPLY TO THESE TERMS AND CONDITIONS. BY CLICKING ON THE "ACCEPT" BUTTON BELOW, YOU AGREE THAT ANY ACTION AT LAW OR IN EQUITY ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS WILL BE FILED ONLY IN STATE OR FEDERAL COURT LOCATED IN TRENTON, NEW JERSEY, AND YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY CONSENT AND SUBMIT TO THE EXCLUSIVE JURISDICTION OF SUCH COURTS OVER ANY SUIT, ACTION OR PROCEEDING ARISING OUT OF THESE TERMS AND CONDITIONS.

Data Destruction
PLANITROI certifies use of United States Department of Defense 5220.22M data destruction. Also, PLANITROI has the equipment, software, and knowledge to either erase data on various media to a higher standard than DOD 5220.22M or to destroy the drive to prevent unscrupulous people from accessing your data.

IT Asset Inventory Methods
Unlike other companies, PLANITROI grades IT assets in several ways using five or more categories. This leads to higher value because only sufficient detailed knowledge about the IT asset can lead to the optimum choice for its use, remarketing, or appropriate destruction. PLANITROI clients receive comprehensive reports on the condition of their former assets.

Release of right to IT asset
When PLANITROI takes possession of your IT asset, PLANITROI does not guarantee that it will be able to return the asset with its media or any data it contains. However, if the IT asset has not been processed or sold at the time of your request, it may be possible to retrieve it and PLANITROI employees will do so for a nominal fee.

Readiness for Sale
PLANITROI clients must possess the right, title, and interest in any and all IT assets you want to remarket through the Company. You are responsible for complying with any applicable laws regarding possession. Any IT assets you wish to sell through PLANITROI through any arrangements shall not infringe on third-party intellectual property right (including copyright, trademarks, patent, trade secrets, or other proprietary rights and shall not be stolen, counterfeit, or fraudulent.

Variation in IT Asset Condition and Condition Statement
You, as a PLANITROI client, may ask a PLANITROI employee or representative to grade your IT assets or you may do so. If you audit or grade your assets, the grade given must agree with the grade that would be given by a PLANITROI employee before a check or checks will be provided for the value of your retired or excess IT assets.

Protection from Licensing Problems
PLANITROI can audit software to assure compliance with licensing agreements. The company will report on software on each hard drive if helpful to your agency or public sector group. This information can be used to prevent licensing liabilities.

EPA regulations
PLANITROI recycles only valueless retired IT assets. The company prides itself on remarketing a very high percentage of the IT assets it handles. To assure customer satisfaction, PLANITROI meets or exceeds all federal, state and local regulations to ensure a safe and healthy environment. PLANITROI provides certificates of indemnification to public sector entities to prevent litigation and public relations damages.

Transmission Problems
PLANITROI strives to make sure that all information about your IT assets you receive is accurate and error-free. In the event of a typographical error, technical inaccuracies, valuation errors, or omissions. PLANITROI reserves the right to correct the inaccuracy or omission in seven (7) calendar days of the transaction. If PLANITROI resolves the error or omission, it will give you these options: (A) proceed according to plan, or (B) Cancel the program. If the latter occurs, PLANITROI will return your retired IT assets if possible or replace them with similar assets.
